Terms of Service — DailyNamer

1. Agreement to Terms

By accessing or using DailyNamer ("the Service"), operated by DailyNamer ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 18 years of age to subscribe to or use DailyNamer. By using the Service, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate accounts that do not meet this requirement.

3. Description of Service

DailyNamer provides one personalized name recommendation per day, delivered via SMS text message. Users set their preferences (including style, gender, origin, and vibe), and our system curates a name recommendation based on those preferences. The Service can be used for baby names, pet names, character names, and other naming purposes. Users may subscribe to multiple name streams if needed (e.g., for twins or multiple pets).

4. Free Trial

We offer a 7-day free trial for new subscribers. A valid credit card is required to start your free trial, but you will not be charged until the 7-day trial period ends. If you cancel before the trial period ends, you will not be charged. If you do not cancel, your subscription will automatically convert to a paid subscription at the then-current rate of $6.99 per month per name.

5. Subscription and Billing

After your free trial, the subscription fee is $6.99 per month per name stream. Billing occurs on a monthly cycle beginning on the date your trial ends. You authorize us to charge your selected payment method for the recurring subscription fee. Prices are subject to change with 30 days' notice.

6. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to receive name recommendations through the end of your current billing cycle. No partial refunds will be issued for the remaining days in a billing period. To cancel, follow the instructions provided via SMS or contact us at [email protected].

7. Refund Policy

Due to the nature of the Service (digital content delivered daily), we generally do not offer refunds for subscription fees already charged. However, if you experience a technical issue that prevents you from receiving your name recommendations, please contact us and we will work with you on a case-by-case basis.

8. SMS Consent and Messaging

By subscribing to DailyNamer, you expressly consent to receive recurring automated SMS text messages at the phone number you provide. Message frequency is one message per name stream per day, plus occasional service updates. Message and data rates may apply depending on your mobile carrier. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact [email protected].

9. Intellectual Property

All content, branding, and materials associated with DailyNamer, including but not limited to text, graphics, logos, and software, are the property of DailyNamer and are protected by applicable intellectual property laws. The names recommended to you are not proprietary — you are free to use any name recommendation for any purpose.

10. Limitation of Liability

DailyNamer is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service. In no event shall DailyNamer be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective upon posting the updated terms on our website. Your continued use of the Service after changes constitutes acceptance of the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
